Common Questions

Frequently Asked Questions

Does a foreign national's will made abroad apply to property in Thailand?

Thai law has its own rules regarding wills and succession for property located within Thailand. A foreign will may be recognised in some circumstances, but Thai courts will often require a probate process here regardless. We review each situation individually to advise on the most appropriate path.

How long does probate typically take in Thai courts?

For straightforward, uncontested estates, probate in Krabi typically moves through the court in three to six months from the date of filing. More complex estates or contested matters take longer. We provide a realistic timeline assessment at the outset of any engagement.

Can a foreigner inherit land or a house in Thailand?

Foreign nationals face restrictions on holding certain types of land title in Thailand. However, condominiums and structures may be inherited under specific conditions. The situation depends on the type of title, the nature of the estate, and the heir's residency status. We assess these questions as part of our Will Review or Full Inheritance Mandate service.

What happens if a person dies without a will in Thailand?

Thai inheritance law sets out a statutory order of heirs — spouses, children, parents, siblings, and so on. When no will exists, assets pass according to this hierarchy. The court appoints an administrator to manage the estate. We assist families navigating this process, including where disputes between heirs arise.

What documents do I need to bring to an initial consultation?

It helps to bring any existing will, the deceased's death certificate (if probate is the matter), property title documents, and your own identification. If documents are not yet available, an initial conversation is still worthwhile — we can clarify what will be needed before proceeding.

Are your fees fixed, or will they change as the matter progresses?

Our service packages carry fixed fees stated clearly before work begins. Where a matter develops in an unexpected direction — for example, if a contested dispute arises mid-process — we discuss any adjustment with you transparently and seek your agreement before continuing.
